Public agent and the actor Chris Evans have filed a lawsuit in the U.S. District Court for the Eastern District of New York against a company called Public Agent LLC.
The complaint alleges that the actor used the public agency’s name and image in marketing a drug called OxyContin to more than 50 patients.
Evans is a public agent and a frequent performer on the ABC television series Agent Carter.
Evans and Public Agent, a company he co-founded, filed the suit on July 23, 2017, seeking a permanent injunction to prevent the actor from using the name and likeness of the agency to promote the drug.
“We are filing a federal lawsuit in support of our clients, including Chris Evans, to protect their First Amendment rights and protect the public from Defendants’ unlawful use of their agency’s trademark and copyright,” Evans’ lawyer, Peter P. Schallen, said in a statement.
The suit names Public Agent and Evans, as well as the American Federation of State, County and Municipal Employees, the American Medical Association and the American Society of Civil Engineers.
In a statement, the public agents said they were disappointed in the lawsuit, which does not address the alleged misuse of the actor’s name by public officials.
The lawsuit also names Public Agency’s president, Robert M. Niebla, as an individual who is the subject of the suit, and seeks an injunction prohibiting him from making or promoting any material or statements that are likely to disparage the public, including disparaging public officials, the press, the judiciary or other public officials in any way.
Public Agent’s president Robert M Nieblea.
(Public Agent) The lawsuit alleges that in addition to being the public body’s “executive director,” Nieblinga is a member of the Board of Directors of Public Agent.
In addition, the suit alleges that Nieblera, in 2014, wrote a book about the agency called Public Agency: The Story Behind the Company.
Niecebla’s lawyer, Brian P. Johnson, said he could not comment on the lawsuit because of the ongoing litigation.
Public Agents, the company behind the OxyContin drug, is owned by a private equity firm, Cerberus Capital Management, which is part of Cerberus Group LP.
Cerberus owns the Detroit Tigers baseball team.
Cerberus’ founder and chief executive, John Malone, is a major shareholder in Public Agent as well.
Cerberus is a registered agent of the American Cancer Society and is also the largest private equity fund in the United States.
Cerberus did not immediately respond to a request for comment.
The OxyContin lawsuit claims that Public Agent was involved in marketing the drug to more that 50 patients at public hospitals in Michigan, Illinois and Indiana.
Public agents, in turn, distributed OxyContin at hospitals, clinics, clinics and other facilities throughout the country.
The suits alleges that Public Agents and Evans are being sued because of a policy that prohibits using a public agency image in promoting a drug or in promoting any other activity.
The public agents, who declined to be named in the suit because of confidentiality agreements, claim they were not authorized to distribute OxyContin and that they had no choice but to use the public agencies image and name in the promotion of the drug, which was prescribed to them by a licensed doctor and is prescribed for people with chronic pain.
In 2015, Public Agent had a license to distribute the drug under a state law that allows it to be dispensed by pharmacies to people in certain circumstances.
The state’s Department of Consumer Protection, which regulates prescription drugs, issued the prescription for OxyContin in 2013.
In 2016, Public Agency was fined $20,000 by the Department of Licensing and Regulation for using a licensed public agency to distribute prescription drugs and for failing to report the use of its name and logo in promoting OxyContin.
In February 2017, Public Agents filed a petition in the state’s appellate court, arguing that it had been unfairly targeted by the state.
The appeal was heard in 2017, but the case is not before the state court.
The American Bar Association, which represents the public servants, did not respond to request for comments.
The Associated Press has reported that Evans has used his public agent persona in the past, including on his television series Agents of S.H.I.E.L.D. and in a 2016 episode of the HBO series Game of Thrones.
In 2017, Evans was named to the list of the “Most Influential People in Entertainment” by Time magazine.
Evans has also appeared on several television shows, including Mad Men, The Voice, Scandal, CSI: Miami and the upcoming Netflix series The Defenders.
